The New York State Health Insurance Program (NYSHIP) provides health coverage to approximately 1.2 million New York State employees, retirees, and their dependents. Under both federal law (the Mental Health Parity and Addiction Equity Act) and New York State law (Timothy's Law), NYSHIP is required to cover substance use disorder treatment — including alcohol rehabilitation — at parity with other medical conditions. This means your alcohol treatment benefits should be comparable to benefits for conditions like diabetes or heart disease.
What NYSHIP Covers for Alcohol Treatment

- •Inpatient rehabilitation — residential treatment programs, typically 28-90 days
- •Partial hospitalization (PHP) — structured day treatment with evening discharge

NYSHIP Empire Plan: Substance Use Benefits
The Empire Plan is the most common NYSHIP option, covering the majority of state employees. For substance use disorder treatment, the Empire Plan uses Beacon Health Options (now Carelon Behavioral Health) to manage behavioral health benefits. In-network providers are strongly recommended to minimize out-of-pocket costs. Preauthorization is required for inpatient and residential treatment — your treatment facility's admissions team will typically handle this on your behalf. Emergency detox admission does not require preauthorization.

While NYSHIP covers alcohol treatment, cost-sharing applies. For the Empire Plan, in-network inpatient treatment typically requires a copay per admission. Outpatient visits have a per-session copay. Medication copays follow the prescription drug benefit tier structure. Out-of-network treatment is covered but at a higher cost to the member. They assume rehab is not covered, or that it will be prohibitively expensive out of pocket. In most cases, NYSHIP provides comprehensive coverage for both detox and rehabilitation.
